Terms & Conditions for All Over Foods Ltd t/a The Scottish Hamper Company.

 

1. Contract.

   All purchases will constitute a contract between the purchaser and All Over Foods Ltd, trading as The Scottish Hamper Company.

2. Definition.  

  • Goods: Refers to the products sold by All Over Foods Ltd.
  • Services: Refers to any services provided by All Over Foods Ltd in relation to the sale of goods.

  • Purchaser: Refers to the individual or entity purchasing goods from All Over Foods Ltd.
  • Supplier: Refers to All Over Foods Ltd.

3. Terms & Conditions. 

  •    These terms and conditions shall be governed by and construed in accordance with Scottish law. By making a purchase, you agree to submit to the jurisdiction of the Courts of Scotland.

4. Payment Terms.

  •    We accept various payment methods, including credit cards from Stripe and PayPal. Payments are processed securely, and applicable taxes or fees will be displayed during the checkout process.

5. Shipping Information.

  • We will dispatch all orders to the delivery address provided by the purchaser. We will not be held responsible for any issues arising from an incorrect postcode or delivery address supplied by the purchaser. No refunds will be issued for postage or compensation for goods due to an incorrect address.  

  • We strongly recommend that customers provide an email address and a local contact telephone number, preferably a mobile number, for the recipient at the time of order placement.  
  • It is the responsibility of both the sender and the recipient to contact the courier and customs regarding any clearance delays or address queries. We advise providing a realistic delivery date, and we will endeavor to deliver as close to that date as possible. However, this may not be feasible during our peak periods in December and January. If no specific delivery date is provided, we will dispatch your order as soon as the item is in stock and will notify you via email upon dispatch. At that point, you are responsible for accepting delivery.  
  • We accept no liability for perishable items delivered late, resulting in goods becoming out of date. We reserve the right to dispatch our haggis frozen during warmer weather, and we will include a note in the chilled box to notify you of this, along with the eat-by date. We will not issue refunds for perishable goods once a delivery attempt has been made.  
  • If you arrange a new delivery date with our courier, we will not be held responsible for any damage to the packaging or if the delay causes the contents to go out of date.

6. Customer Complaints.

  •    We will respond to all complaints within five working days.

7. Quality of Goods.

  •    All fresh foods are dispatched in insulated boxes to ensure freshness. We guarantee that all products are of the highest quality and comply with UK legislative standards.

8. Force Majeure.

  • We will make every reasonable effort to meet any quoted or dispatch date. However, we will not be liable for any loss or damage due to delays or failures in shipment resulting from causes beyond our control, such as unforeseen weather conditions, compliance with laws or regulations, acts of God, acts of civil or military authority, judicial action, delays in transportation, embargoes, labor disputes, wars, riots, or pandemics.

9. Privacy Statement.

  •    We are committed to protecting your privacy. We will only use the information we collect about you lawfully (in accordance with the Data Protection Act 1998).  
  •    We collect your information for two primary reasons: first, to process your order, and second, to provide you with the best possible customer service.  
  •    We will not email you again unless you have consented to receive further communications. The information we collect includes your name, address, contact number, email address, and debit/credit card information.

10. Stock Levels.

  •     We reserve the right to send you the equivalent weight of haggis if the advertised weights are unavailable.

11. International Deliveries (outside the UK and EU).

  •     Due to Brexit regulations, we cannot deliver outside the UK Mainland. 
  •     We can dispatch all our products, except for our natural skinned haggis, to worldwide destinations, excluding the USA.  
  •     We will not be responsible for delays caused by customs clearance and will not refund the cost of the products or shipping fees if the order is held or delayed by customs.  
  •     Please note that in some cases, the recipient may incur charges from local customs for receiving the products. We will not be liable for any local taxation or customs charges.  
  •     If you have any doubts, please do not place an order. Should your order be held or delayed by customs, the customer is responsible for communication with them and our couriers to resolve the issue.

12. Returned Goods/Refunds. 

  •     If you request a refund, we will gladly provide one, but we must receive the returned goods before processing the refund.  
  •     The customer is responsible for the cost of return postage or may opt to pay us in advance for return arrangements.  
  •     For damaged products, customers must provide photographic evidence within 24 hours of receipt of the parcel.  
  •     Please note that we do not accept refunds on fresh food items.

13. Unforeseen Weather Conditions.

  •     We always dispatch orders in accordance with the customer's instructions.  
  •     We will not be responsible for any delays in the delivery of goods caused by adverse weather conditions. Refunds will not be issued for goods or shipping charges due to such delays. By accepting our terms and conditions at checkout, you agree to this clause.

14. Orders for Chieftain/Ceremonial Haggis.  

  •     Please note that we maintain ample stock of these items in December and January, but allow an additional three days for shipping during the rest of the year, as these items are made to order.

15. Substitution of Hamper Contents. 

  •     We reserve the right to substitute hamper contents but will always endeavor to supply a similar item of equivalent or greater value than the product being substituted.

16. Age of Consent.  

  •     By placing an order and agreeing to our terms and conditions, the buyer declares that they are of the appropriate legal age to purchase the goods and/or services. Items containing alcohol may only be ordered by and delivered to individuals aged 18 or over and must not be purchased for onward supply to persons under 18 (UK).  
  •     If the supplier discovers that the buyer is not legally entitled to order certain goods and/or services, the supplier shall have the right to cancel the order immediately without notice.

17. Website Liability.

  •     We make every effort to ensure that our website is as accurate as possible; however, we accept no responsibility for any loss resulting from information contained on our website or for any omissions or errors. We provide no warranty regarding the information on our website. To the extent permitted by law, by using www.Scottish-hampers.com, you agree that we will not be liable to you or any third party for any loss or incidental damages arising from your use of our website.

18. Right to Cancel.

  •     Your right to cancel begins at the time of placing the order. As all our products are food and thus perishable, your right to cancel ceases upon dispatch. We reserve the right to cancel your orders due to events outside our control or unavailability of stock. In such instances, we will promptly contact you. If we must cancel an order under these circumstances and you have made any advance payment for products not delivered to you, we will refund these amounts as soon as possible.

  •     We welcome customer feedback and reviews. However, we reserve the right to moderate and remove any content that we deem inappropriate or offensive. 

21.Free Delivery 

  • Our free delivery offer only applies to mainland UK addresses and is not available for areas that incur a surcharge.
